1. Acceptance of Terms

By accessing or using PixServe ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms constitute a legally binding agreement between you and PixServe LLC.

We reserve the right to refuse service to anyone for any reason at any time.

2. Description of Service

PixServe LLC ("PixServe", "we", "us", "our") provides a free image hosting service that allows users to upload, store, and share images via the internet. Users may upload images which are accessible via unique URLs. Images are served through a global content delivery network (CDN) to ensure fast and reliable access.

We do not guarantee any particular level of uptime, storage duration, or bandwidth. The Service may be modified, suspended, or discontinued at any time without prior notice.

3. User Accounts

Since March 2024, uploads require a registered account. You must provide a valid email address to create an account. You are responsible for maintaining the confidentiality and security of your account credentials. You agree to notify us immediately of any unauthorized use of your account.

You may not create accounts for the purpose of automating uploads, circumventing rate limits, or any other form of abuse. We reserve the right to suspend or terminate accounts that violate these Terms.

Images uploaded anonymously before March 2024 remain accessible and are not affected by the account requirement.

4. User Content

Users upload content at their own discretion. PixServe does not review, endorse, or pre-screen uploaded content.

You retain all ownership rights in the content you upload. By uploading content to PixServe, you grant PixServe a worldwide, non-exclusive, royalty-free license to store, cache, reproduce, and distribute the content via CDN for the sole purpose of operating and providing the Service. This license terminates when you delete your content from the Service.

You represent and warrant that you have all necessary rights to upload the content and grant the license described above, and that your content does not infringe upon the intellectual property rights of any third party.

5. Prohibited Content

You may not upload, store, or distribute content that:

  • Constitutes child sexual abuse material (CSAM) or the exploitation of minors in any form
  • Contains malware, viruses, trojans, or any other malicious code
  • Is used for spam, phishing, or social engineering attacks
  • Violates any applicable local, state, national, or international law
  • Infringes upon the intellectual property rights of others
  • Contains threats of violence or promotes terrorism

We reserve the right to remove any content and terminate any account that violates these prohibitions, without prior notice. CSAM violations are reported to the National Center for Missing & Exploited Children (NCMEC) and relevant law enforcement agencies.

6. Intellectual Property & DMCA

We respect intellectual property rights and expect our users to do the same. As a provider of an interactive computer service (47 U.S.C. § 230), PixServe is not the information content provider of user-uploaded material.

If you believe that content hosted on PixServe infringes your copyright, you may submit a takedown notice in accordance with the Digital Millennium Copyright Act (DMCA). For detailed instructions and our designated DMCA agent's contact information, please see our DMCA Policy.

We will respond to valid DMCA takedown notices and, where appropriate, remove or disable access to the allegedly infringing material.

7. Data Practices

PixServe collects minimal information: email address (for account holders) and upload metadata. IP addresses are retained for 72 hours for abuse prevention and then permanently deleted.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

PixServe does not warrant that the Service will be uninterrupted, secure, or error-free, that defects will be corrected, or that the Service or the servers that make it available are free of viruses or other harmful components. PixServe does not warrant or make any representations regarding the permanence of stored content.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PIXSERVE LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SERVICE.

IN NO EVENT SHALL PIXSERVE'S AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE EXCEED ONE HUNDRED DOLLARS ($100.00 USD).

10. Governing Law & Venue

All disputes arising out of or relating to these Terms or the Service shall be governed by the laws of the State of Wyoming, United States, without regard to conflict of law provisions.

Any legal action or proceeding arising under these Terms must be brought exclusively in the state or federal courts located in Sheridan County, Wyoming. You hereby irrevocably consent to the personal jurisdiction and venue of such courts.

11. Changes to Terms

We may update or modify these Terms at any time by posting the revised Terms on this page and updating the "Last updated" date. It is your responsibility to review these Terms periodically. Your continued use of the Service after any changes constitutes acceptance of the revised Terms.

For material changes, we will make reasonable efforts to notify registered users via the email address associated with their account.
